These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "your") and TechTailor LLC, doing business as Suit Century ("Company," "we," "us," or "our"), concerning your access to and use of the suitcentury.com website (the "Site"). We are registered in New York, United States, with our principal office at 1000 Hylan Dr, Jay Scutti Plaza, Rochester, NY 14623.

By accessing or using the Site, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must discontinue use of the Site immediately.

1. Eligibility

By using the Site, you represent that you are at least 13 years of age. If you are between 13 and 18 years old, you may use the Site only with the involvement and consent of a parent or legal guardian. You must have the legal capacity to enter into a binding agreement to place an order.

2. Account Registration

To access certain features of the Site, you may be required to create an account. You agree to:

• Provide accurate, current, and complete registration information.
• Maintain and promptly update your account information.
• Keep your password confidential and not share it with others.
• Notify us immediately of any unauthorized use of your account.

3. Products and Orders

Product Descriptions

We make every effort to display product colors, features, and details as accurately as possible. However, we cannot guarantee that your device's display will accurately reflect actual product colors. All products are subject to availability, and we reserve the right to discontinue any product at any time.

Pricing and Taxes

All prices are listed in U.S. dollars (USD) and are subject to change without notice. Applicable sales tax will be calculated and added at checkout based on your shipping address, in accordance with state and local tax laws. We reserve the right to correct pricing errors. If an item's price was incorrectly listed at the time of your order, we will contact you before processing the order.

Order Acceptance and Cancellation

Your placement of an order constitutes an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity. If we cancel your order after payment has been collected, we will issue a full refund to your original payment method.

4. Payment Terms

We accept the following payment methods through our third-party payment processors:

• Credit and debit cards (Visa, Mastercard, American Express, Discover) — processed by Stripe.
• Digital wallets — Apple Pay, Google Pay, Cash App, Link.
• Buy Now, Pay Later — Klarna, Affirm. These services are subject to their own terms and conditions, including credit approval. If your application is declined by the provider, your order will not be processed and you will need to select an alternative payment method.
• Amazon Pay — using your Amazon account for payment.

By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge it for your order total, including applicable taxes and shipping fees.

We do not store your full credit card information on our servers. All payment data is handled by PCI DSS-certified processors.

Payment Disputes

If you have a concern about a charge, we encourage you to contact us at [email protected] before filing a dispute with your bank or payment provider. We are committed to resolving issues promptly and fairly. Filing a chargeback that is determined to be fraudulent may result in suspension of your account and recovery of the disputed amount plus any fees incurred. Nothing in this section limits your rights under the Fair Credit Billing Act or any applicable consumer protection law.

5. Shipping

Shipping timelines are estimates and are not guaranteed. We are not responsible for delays caused by carriers, weather, customs, or other circumstances beyond our control.

6. Returns and Refunds

Please review our Refund Policy before making a purchase. By placing an order, you acknowledge that you have read and agree to our return and refund terms.

7. Size Calculator and Measurements

Our size calculator provides recommendations based on the body measurements and preferences you provide. While we strive for accuracy, size recommendations are estimates and may vary based on individual body shape, fit preferences, and measurement accuracy. We are not responsible for sizing issues that result from inaccurate measurements provided by you.

Body measurement data you submit is stored in accordance with our Privacy Policy.

8. Group Events

Our group event feature allows event organizers to coordinate suit purchases for multiple participants (e.g., weddings, proms, special events). By using this feature:

• Event organizers are responsible for providing accurate event details and participant contact information. By adding participants, you confirm you have their consent to share their information with us.
• Participants are individually responsible for their own orders, payments, sizing information, and meeting any applicable deadlines. The event organizer is not financially liable for participants' orders unless otherwise agreed.
• Event-specific coupon codes and group pricing are subject to the terms specified at the time of event creation and may not be combined with other promotions.

9. Promotions and Coupon Codes

We may offer promotional discounts, coupon codes, or special pricing from time to time. Unless otherwise stated:

• Coupon codes are limited to one per order and cannot be combined with other offers.
• Promotions may have expiration dates, usage limits, or minimum purchase requirements.
• We reserve the right to cancel orders or revoke discounts if a coupon code is used in violation of its terms, shared without authorization, or obtained through fraudulent means.
• Promotional pricing does not apply to previous purchases and cannot be applied retroactively.

Order Limits and Resale

Products purchased through the Site are for personal use only and may not be resold or redistributed commercially without our written consent. We reserve the right to limit order quantities per person, per household, or per order at our discretion. Orders suspected of being placed for commercial resale may be canceled.

10. Home Try-On Program

If you participate in our Home Try-On program, you agree to:

• Return all try-on items within 15 days. The 15-day period counts only the days the items are in your possession — shipping transit days (both to you and back to us) are not counted. The Home Try-On program operates within the standard 30-day return window.
• Return items in their original condition — unworn, unwashed, and with all tags attached.
• Items not returned within 15 days of delivery may be charged to the payment method on file at full retail price.
• Items returned in damaged, stained, altered, or otherwise non-original condition may be subject to a restocking or damage fee.

11. Alteration Services

We may offer optional alteration services for purchased suits. Alteration recommendations are based on the measurements you provide. We are not responsible for fit issues resulting from inaccurate measurements. Once alterations have been performed, the item may no longer be eligible for return or exchange, as specified in our Refund Policy.

12. Intellectual Property

All content on the Site — including text, graphics, logos, images, photographs, product designs, software, and page layout — is the property of TechTailor LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not:

• Copy, reproduce, or redistribute any content without our written permission.
• Use our trademarks, logos, or brand name without authorization.
• Scrape, crawl, or use automated tools to extract data from the Site.

13. User Content

If you submit content to the Site (including reviews, photos, comments, or feedback), you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, and distribute that content in connection with our business, including marketing and promotional materials.

You represent that any content you submit is accurate, does not violate any third party's rights, and complies with these Terms. We reserve the right to remove any user content at our discretion.

14. Prohibited Activities

You agree not to:

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy or completeness of any information on the Site.

For physical products, we warrant that items will be free from manufacturing defects at the time of delivery. This warranty does not cover normal wear and tear, damage caused by misuse, or alterations made after purchase. Our liability for defective products is limited to replacement or refund as described in our Refund Policy.

17. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TECHTAILOR LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

18. Indemnification

You agree to indemnify, defend, and hold harmless TechTailor LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third party's rights; or (d) any content you submit to the Site.

19. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.

Any dispute arising from these Terms or your use of the Site shall first be resolved through good-faith informal negotiation for at least thirty (30) days. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in Monroe County, New York, in accordance with the rules of the American Arbitration Association. Either party may bring an individual action in small claims court in Monroe County, New York, as an alternative to arbitration.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, class arbitration, or representative proceeding.

Arbitration Opt-Out

You may opt out of the arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of the arbitration provision. If you opt out, all disputes will be resolved in the state or federal courts located in Monroe County, New York.

20. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, supply chain disruptions, carrier delays, labor disputes, or interruptions in telecommunications or internet services.

21. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective when posted on the Site with an updated "Last updated" date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.

22. Electronic Communications

By using the Site, creating an account, or making a purchase, you consent to receive electronic communications from us (including order confirmations, shipping updates, and account notifications). You agree that all agreements, notices, and other communications provided electronically satisfy any legal requirement that such communications be in writing.
